Use of the site

You may browse the Site, contact us, and read its content for personal or commercial evaluation. You agree not to:

  • use the Site in any way that breaches applicable law;
  • scrape, mirror, frame, reverse-engineer or extract substantial parts of the content;
  • use automated means (bots, scrapers, crawlers) other than well-behaved search engine crawlers respecting our robots.txt;
  • send unsolicited commercial communication via the contact form;
  • attempt to gain unauthorised access to any part of the Site or its underlying infrastructure;
  • upload or transmit malicious code or anything unlawful, defamatory, or infringing.

Engagements and offers

Content on the Site (including service descriptions, prices, ranges and indicative timelines) is informational and does not constitute a binding offer. Any engagement is governed exclusively by a separately signed Statement of Work (SoW), Master Services Agreement (MSA) or equivalent written contract between you (or your company) and MIT-DEV, which prevails over any communication on the Site.

Intellectual property

All content on the Site (text, graphics, logos, code samples, design system, brandbook) is owned by MIT-DEV or licensed to it, and is protected by copyright and trade-mark law. Subject to attribution, you may share short excerpts for commentary or evaluation. You may not reproduce, distribute or create derivative works at scale without prior written permission.

Open-source code we publish (e.g. on GitHub) is licensed under the licence stated in each repository and is not affected by these Terms.

Third-party links and services

The Site may link to third-party websites or use third-party services (e.g. analytics, email delivery). We are not responsible for the content, policies or practices of those third parties. Their use is governed by their own terms and privacy notices.

No warranty

The Site is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components.

Limitation of liability

To the maximum extent permitted by applicable law, MIT-DEV will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from your use of the Site. Our total aggregate liability for any direct damages arising from your use of the Site is limited to EUR 100. This clause does not limit liability for fraud, gross negligence or any liability that cannot be limited under Moldovan law.

Indemnity

You agree to defend, indemnify and hold harmless MIT-DEV, its administrators, employees and contractors from any claim, demand, loss or expense (including reasonable lawyers' fees) arising from your breach of these Terms or your unlawful use of the Site.

Privacy

Our processing of personal data is governed by our Privacy Policy at /privacy, which is incorporated into these Terms by reference.

Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above reflects the current version. Material changes will be highlighted on this page; continued use of the Site after changes constitutes acceptance of the updated Terms.

Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Moldova. Any dispute arising out of or in connection with these Terms is subject to the exclusive jurisdiction of the competent courts of Chișinău, Republic of Moldova, without prejudice to mandatory consumer-protection rules in your country of habitual residence.
